Chief Justice Willy Mutunga’s on the last official courtroom appearance will be to preside over the split of five-judge Supreme Court bench that will determine whether to provide Justices Rawal and Tunoi with a 21-day grace period after their fate was sealed by a 3-2 vote on Tuesday.

Justices Mutunga, Ibrahim Mohamed and Smokin Wanjala unanimously endorsed the seven-member Court of Appeal decision that declared all Judges must retire at age of 70 years irrespective of whether they were appointed before or after the declaration of the 2010 Constitution.

the JSC Secretary, who doubles up as the Chief Registrar of the Judiciary, Anne Amadi, recently issued a press statement giving details of the programme seeking the replacement of Dr Mutunga. Once all those who are interested in the position place their applications, they will be shortlisted and interviewed by the JSC.
